Royal Homecare Nanny Placement Terms & Conditions

For Services in Ireland

These Terms and Conditions (the "Agreement") govern the provision of nanny placement services by Royal Homecare (the "Agency") to clients (the "Employer" or "Client" for self-employed nannies) in Ireland. By using our services, you agree to abide by the terms and conditions outlined below.

1.     General Terms of Service

Eligibility: By engaging our services, you confirm that you are a legal resident of Ireland and are capable of entering into a binding contract.

Service Agreement: These Terms and Conditions form part of your service agreement with Royal Homecare. By proceeding with a placement, you acknowledge that you have read, understood, and agree to these terms.

Scope of Services: The Agency provides professional nanny placement services, including recruitment, screening, vetting, and post-placement support. We specialize in full-time, part-time, temporary, and live-in/live-out nanny placements.

2.     Fees and Payments

Placement Fees: Placement fees are detailed in our brochure and website, and they vary based on the type of nanny placement (full-time, part-time, temporary, live-in, or live-out). The fee structure and payment terms will be confirmed with the Employer during the initial consultation.

Payment Schedule: The Agency requires payment of the placement fee in full before services commence unless an alternative payment plan has been agreed upon.

VAT: All placement fees are subject to VAT as mandated by Irish tax law.

Additional Costs: The Employer is responsible for any additional expenses, including but not limited to the nanny’s travel, accommodation (for live-in placements), and other agreed-upon costs.

 

3.     Nanny Replacement Guarantee

Eligibility for Replacement: If a full-time nanny leaves within the first three months of placement, the Agency will provide one free replacement, subject to the terms of this Agreement.

Limitations: The replacement guarantee applies only to full-time placements and does not extend to temporary or short-term placements. The replacement will be for a full-time position only and is valid for one occurrence within the initial three-month period.

4.     Employer Responsibilities

Compliance with Irish Employment Law: Employers must adhere to all applicable Irish employment laws, including those governing wages, taxes, working hours, holiday entitlements, and workplace conditions. Employers must register with the Irish Revenue Commissioners and ensure full compliance with employment regulations.

Work Environment: Employers must provide a safe, respectful, and legally compliant work environment, including necessary tools and accommodation (if applicable) to enable the nanny to perform their duties effectively.

Salary and Benefits: Employers are responsible for timely payment of agreed-upon wages and benefits. Employers must deduct PAYE tax, pay PRSI contributions, and provide other statutory entitlements as required by law.

Communication: Employers are expected to maintain open communication with the Agency regarding any concerns or performance-related issues and must notify the Agency immediately in the event of any significant concerns.

5.     Self-Employed Nannies / Childcare Professionals

Independent Contractors: Self-employed nannies and childcare professionals are classified as independent contractors and are not employees of Royal Homecare. They are solely responsible for their own taxes, PRSI, and compliance with Irish statutory obligations.

Temporary and Short-Term Only: Self-employed or contractor placements are strictly limited to temporary and short-term positions. All full-time childcare professionals must be directly employed by the Client, who will act as their Employer.

Vetting Process: Self-employed professionals undergo the same rigorous vetting procedures as employed nannies, including Garda Vetting, reference checks, and qualification verification.

Client Responsibilities: The Client must directly manage contractual agreements, work arrangements, and payments with self-employed professionals and assumes full responsibility for ensuring a safe work environment.

Insurance: For all temporary and short-term placements, the Client is responsible for arranging appropriate insurance coverage for the nanny.

 

6.     Vetting Procedure and Liability

Background Checks: The Agency uses its best endeavours to conduct thorough background screening, including Garda Vetting, verification of qualifications, and reference checks.

Performance Disclaimer: While we use our best endeavours to vet all candidates, we cannot guarantee a nanny’s long-term performance, conduct, or suitability beyond the vetting process.

Employer/Client Responsibility: The Employer/Client is solely responsible for overseeing and managing the nanny’s performance and implementing any disciplinary procedures if necessary.

Limitation of Liability: The Agency shall not be held liable for any actions, omissions, or misconduct of the nanny after placement. This includes but is not limited to childcare practices, household interactions, and any other professional or personal conduct within the Employer’s home.

7.     Termination of Placement

Employer’s Right to Terminate: Employers may terminate the employment relationship at any time, provided that all contractual and legal obligations, including notice periods, are adhered to.

Nanny’s Right to Terminate: Nannies also reserve the right to terminate their employment, subject to the contractual notice requirements.

Agency’s Role: If employment is terminated within the first three months, the Agency will facilitate mediation and, if applicable, provide a replacement nanny under the terms of the replacement guarantee.

8.     Post-Placement Support

Continued Support: The Agency maintains ongoing communication with both Employers and nannies to facilitate a smooth integration process.

Mediation Services: The Agency offers assistance in resolving disputes or concerns to promote a positive and successful working relationship.

9.     Confidentiality

Data Protection: The Agency adheres to GDPR and Irish data protection laws in handling all personal information related to both nannies and Employers.

Confidentiality Agreement: Employers and the Agency mutually agree to uphold confidentiality regarding all personal and professional details of nannies and clients.

10.  Governing Law

These Terms and Conditions are governed by the laws of Ireland. Any disputes arising from nanny placements shall be resolved in accordance with Irish legal procedures.
